31 May, 2025 | Sambhal: In a significant legal victory, the Association for Protection of Civil Rights (APCR) has successfully secured bail for Mohammad Arshad, a victim of the Sambhal violence who was falsely implicated and incarcerated under serious charges.
Arshad was arrested in connection with the violence that took place on 24 November 2024, during a controversial survey near Jama Masjid that triggered widespread unrest in the area. He, along with several others, was accused of being present at the scene, engaging in rioting, arson, and stone pelting, and allegedly attacking the police while attempting to incite communal tensions. Following the incident, he was reportedly absconding and was later apprehended and sent to judicial custody. Arshad was then booked under multiple stringent provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, including Sections 109(1), 117(2), 121(2), 132, 190, 191(2), 191(3), 223(b), as well as Section 7 of the Criminal Law (Amendment) Act, 1932.
The bail application was argued by Advocate Ghazala Bano Qadri and Advocate Syed Maseeh Uddin, representing APCR. Our legal team contested the charges and presented evidence highlighting Arshad’s innocence and the arbitrary nature of his arrest as part of a broader pattern of targeting marginalized youth in the aftermath of communal tensions.
The Allahabad High Court, after hearing the matter, granted bail, offering a measure of relief to Arshad and his family.
